General Terms and Conditions of Sale (GTC) — Momtaz

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between:

(hereinafter "the Seller" or "Momtaz"),

and any individual or legal entity (hereinafter "the Customer") wishing to purchase one or more contemporary carpets manufactured or distributed by Momtaz.

1. Purpose

These GTC define the conditions applicable to any order placed with Momtaz, whether it concerns:

  • carpets available in stock, or

  • carpets manufactured to order (custom-made or personalized).

Any order implies the Customer's full and complete acceptance of these GTC.

2. Manufacturing and Expertise

Momtaz designs and manufactures high-end contemporary carpets, created using traditional techniques:

  • Hand knotted

  • Hand tufted

Origin and Production:

  • Turkey 🇹🇷: Momtaz owns its own production facility, guaranteeing total control over quality and deadlines.

  • Nepal 🇳🇵: Momtaz is a shareholder in partner workshops, ensuring direct oversight of creations and ethical standards.

  • India 🇮🇳: Momtaz collaborates with selected subcontractors for their artisanal expertise and compliance with the brand's quality requirements.

Each carpet is handmade, making each piece unique.
Slight variations in color, texture or dimensions may occur and do not constitute a defect.

Photographs, sketches, samples or technical sheets are provided for information purposes only and have no contractual value.

3. Stock and Availability

Momtaz has a limited stock of carpets available for immediate sale.
These products are offered subject to availability at the time of order.

For made-to-order carpets, a production lead time is indicated to the Customer upon validation of the quote.

4. Ordering

Any order must be the subject of a signed quote or purchase order.

For made-to-order carpets:

  • A 50% deposit of the total amount including tax is required upon ordering.

  • The remaining 50% must be paid before delivery or before collection.

Manufacturing begins only after receipt of the deposit.

For stock carpets: Payment of the full price is required upon ordering before shipping.

5. Prices and Payment Terms

Prices are expressed in euros (€), all taxes included (TTC).
They are set based on the signed quote or rates in effect at the date of order.

Payments can be made by bank transfer, check, or any other means agreed upon with Momtaz.

Any payment delay will result in:

  • late payment interest calculated according to the legal rate,

  • and a fixed compensation of €40 for recovery costs (article L.441-10 of the Commercial Code).

6. Lead Times and Delivery

Stock carpets are delivered upon receipt of full payment.

Made-to-order carpets are subject to a manufacturing lead time communicated for information purposes, depending on:

  • the technique used (hand knotted or hand tufted),

  • the place of production (Turkey, Nepal or India),

  • and international logistics conditions.

Delivery occurs only after full payment of the price.
Transportation risks are borne by the Customer, unless otherwise stipulated.

7. Modifications or Cancellations

Given the artisanal and custom nature of production,
any modification request must be made in writing and accepted by Momtaz.

In case of cancellation after production has begun, the 50% deposit remains acquired by Momtaz as compensation.

8. Receipt and Claims

The Customer must inspect the products upon delivery.
Any claim (damage, error, non-conformity) must be made in writing within 48 hours following receipt.
After this period, products are considered accepted.

9. Warranties

Momtaz carpets benefit from legal warranties:

  • Warranty of conformity (articles L.217-4 to L.217-14 of the Consumer Code),

  • Warranty against hidden defects (articles 1641 to 1649 of the Civil Code).

Not covered:

  • natural differences in shade or texture,

  • normal wear and tear related to use,

  • damage due to inappropriate maintenance or excessive exposure (light, humidity, etc.).

10. Intellectual Property

Models, designs, patterns, sketches and visuals created by Momtaz remain its exclusive property.
Any reproduction, distribution or exploitation without prior written authorization is prohibited.

11. Personal Data

Data collected in connection with orders is used exclusively for their processing and customer follow-up.
They are kept in accordance with GDPR and Momtaz's Privacy Policy.

12. Force Majeure

Momtaz cannot be held responsible for delays or impossibilities of execution resulting from circumstances beyond its control (strike, conflict, pandemic, customs blockage, natural disaster, etc.).

13. Applicable Law and Competent Jurisdiction

These GTC are governed by French law.
Any dispute relating to their interpretation or execution will be submitted to the exclusive jurisdiction of the Paris courts.
